Terms of Service

DrayQuote is an online marketplace for intermodal drayage quoting, carrier matching, booking coordination, and related communications. We are not a motor carrier. Unless a separate written brokerage agreement says otherwise, we provide software and brokerage coordination, not transportation itself.

If you do not agree to these Terms, do not use the Service.

DrayQuote LLC is the technology and marketplace platform provider. It is not a freight broker and is not the transportation provider.

Transportability LLC is the licensed transportation broker for brokered shipments arranged through DrayQuote. Brokered quotes and bookings are identified as “Brokered by Transportability LLC through DrayQuote.” Direct paid AutoRate bookings are with the quoting motor carrier.

You must provide accurate information and keep your password confidential. You are responsible for activity on your account. We may suspend or close accounts that are inaccurate, abusive, or in violation of these Terms or law.

The Service is for commercial use in the United States by adults 18 or older.

Shipper accounts are free. Quotes are estimates based on information you enter and on carrier data in our system. A quote is not a binding contract until it is accepted and booked under the process we provide (including any rate confirmation or other documents).

You are responsible for the accuracy of addresses, cargo, weight, and accessorial needs. Additional charges may apply when facts on the ground differ from the quote request.

Carriers may use a free account (manual RFQ replies) or a paid AutoRate subscription. You represent that you are duly authorized, hold required operating authority and insurance, and that rates you publish are ones you are prepared to honor for matching lanes.

AutoRate quotes are generated from your profile. Keep rates, service area, and company address current. You remain responsible for performing accepted work under the booking documents.

Paid carrier plans are subscriptions billed in advance on a monthly or annual cycle through Square. Receipts and payment notices are issued by Square as DrayQuote - A Transportability LLC company. Subscriptions renew until you cancel in your account or by contacting us before the next billing date.

Fees may change at the end of a billing cycle with prior notice. Taxes may apply. Failed payments may result in loss of AutoRate features until the invoice is paid.

We may offer a trial at our discretion. Unless we say otherwise in the offer, a trial does not require a card and reverts to a free carrier account when it ends.

We send transactional email required to operate the Service (quotes, booking, security). You may receive product updates. You can opt out of marketing using the unsubscribe link. Transactional messages will still be sent while you have an account.

Do not misuse the Service: no scraping beyond reasonable use, no attempts to bypass security, no posting unlawful freight, no impersonation, and no uploading malware. Do not use the Service to violate export, sanctions, or transportation law.

DrayQuote, Connecting Capacity, and Advantage+ AutoRate are names and systems of DrayQuote LLC or its parent. You receive a limited, revocable license to use the Service. You keep ownership of your company data. You grant us a license to use that data solely to operate and improve the Service.

THE SERVICE IS PROVIDED "AS IS." WE DO NOT WARRANT uninterrupted or error-free operation, that every lane will have coverage, or that a quoted rate will remain available until booking. Transit times and accessorials can change with the move.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DrayQuote LLC AND Transportability LLC ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR SUBSCRIPTIONS IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS. These limits do not apply to liability that cannot be limited under applicable law.

You will defend and indemnify DrayQuote LLC and Transportability LLC against claims arising from your freight, your content, your breach of these Terms, or your violation of law.

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, nonpayment, or risk to the platform. Sections that by their nature should survive (including 8 through 14) will survive.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Courts in Georgia have exclusive jurisdiction, except that we may seek injunctive relief anywhere.

We may update these Terms. The effective date will change. Continued use after the update is acceptance of the new Terms for future use. Material changes to paid subscriptions will apply from the next billing cycle unless the law requires otherwise.
